I'm no legal beagle, but if states currently have laws on the books prohibiting using a still to make hotwater, the federal case would not have any bearing. States are sovereign unless Federal authority is specifically granted in the Constitution, I think that is how it works.

T-Man . . . you are "sorta" correct. It can be legal under federal law . . . and states can prohibit it . . . just like our gun laws presently across the nation . . . NY and Hellinois flaunt the 2nd amendment all the time . . . because they are tightening the law.
If the feds prohibit something . . . the sovereign idea of the states goes out the window if they want to allow it or otherwise loosen federal statutes. Again . . . using gun laws for example . . . Ohio could not make it totally legal for residents to own and use silencers or machine guns . . . as the feds prohibit it and federal law would then prevail.

Dwight, I agree. If Federal law prohibits something, the states should have to abide by it. It does seem like legalizing pot was an exception...
